Terms of service

Effective October 27, 2026.

Who we are and what these terms cover

These terms are an agreement between you and FutCo LLC, a California limited liability company ("we", "us"). They cover your use of E3D Pilot at pilot.e3d.ai, including the website, the dashboard, API keys and connectors (together, the "Service"). By ticking the box to accept them, or by using the Service, you agree to them. If you accept for a company, you confirm that you have authority to bind that company, and "you" then means the company. These terms were adopted by the owner of FutCo LLC and have not been reviewed by a lawyer.

The Service

E3D Pilot sends a question you submit to several third-party AI models and returns their answers together with a summary. The Service is meant for business use. You must be at least 18 years old to use it. Some features are labeled as in development or may be switched off; we may change, add or remove features.

Early preview

The Service is in an invite-only early preview. During the preview it is provided as is, with no commitment to uptime or availability. Features, limits and pricing may change, and we may change them without asking you first.

Trying the Service without an account

If we offer a short version of the Service on our website that you can try without an account, these terms apply to that use, except the parts about accounts, keys, credits, plans and payment. A try sends the text you enter to the AI model companies named on the page to answer it, as described in "Your content and where it goes". Do not paste passwords, secret keys, personal information or confidential text into it. You may run a small number of tries; we set the limits and may change or stop them, or the try page, at any time. Do not use the try page by automated means, to get around its limits, or to collect answers in bulk. A try gives you no account, credits, invite or right to use the rest of the Service. Answers are generated by AI models and are not advice.

Accounts and keys

Give us a working email address and keep your password, API keys and connector access private. You are responsible for what happens under your account, keys and connectors, including their use by anyone you give them to. Tell us at support@pilot.e3d.ai if you think a key or account has been misused.

Your content and where it goes

"Your content" means the questions you submit and the answers, summaries and records the Service produces for you. You keep your rights in your content. You give us only the permission needed to run the Service for you: to process, store and send it as described in these terms and in the Privacy policy. To answer a question we send its text to the AI model companies on your panel (Anthropic, OpenAI, Google and xAI, as selected for your account). In later rounds they also receive each other's answers, which can repeat parts of your question. Web search is on by default for every model company on your panel: a model company may send your question text to its own search tool and the search provider behind it. You can turn web search off for a debate (on the Ask page, or per request from a connected AI app). Do not submit anything you are not allowed to share with those companies, and do not submit passwords, secret keys, or sensitive personal information such as health, financial account or government identification data.

No training on your content

We do not train AI models on your content. The model companies named above run their models under their own terms and privacy practices, which apply to what they receive from us. We do not control and do not promise what they keep, for how long, or what they do with it. The Privacy policy says how long we keep your content.

Acceptable use

Do not use the Service to break the law, to infringe anyone's rights, or to send content you have no right to send to a third party. Do not probe, disrupt or get around limits or security measures, use the try page by automated means, share your keys with people outside your organization, or extract answers in bulk to build a competing product or train a model. We may suspend or end an account, key or connector to stop abuse or a security risk, and will tell you by email where we can.

Credits and payment

Credits are prepaid and are used as each debate runs, at the price shown when you buy or run it. Payments are handled by Stripe, and we do not receive your card number. Stripe is the seller of record for your purchase: it charges your card, collects and pays any sales tax, VAT or similar tax that applies, and sends you the receipt. Any tax is shown at checkout. The Service, refunds and support remain ours under these terms. Credits cannot be transferred.

Refunds

Unused credits from a purchase are refundable within 30 days of that purchase. To ask, email support@pilot.e3d.ai from your account email. We refund the part of the purchase that matches the credits from it that are still unused, up to the amount you paid, to the original payment method through Stripe, and we remove those credits from your balance. Credits you have already used are not refundable. If a payment is refunded or disputed through Stripe or your card issuer, we may remove the matching credits from your balance. If you close your account, any remaining credits are forfeited after you confirm; to claim a refund that is still inside the 30 days, ask us before you close it.

Credits you buy do not expire

Credits you buy do not expire. A monthly allowance from a plan resets each month, as described in the section on plans, and that reset never removes credits you bought. Free starter credits are different: they expire, as the next section describes.

Starter credits

Starter credits are free. We grant them once per person. They expire 30 days after we grant them, and any that are unused at that point are removed from your balance. Starter credits have no cash value, cannot be exchanged for money and are not refundable.

Plans and the monthly allowance

Where we offer plans to your account, you can subscribe to one. A plan is a subscription for one seat, on the Basic or the Pro tier; Basic and Pro differ only in the size of the monthly allowance and the price. Each month of a plan gives you a monthly allowance for debates. It resets at the start of each month of your plan, and unused monthly allowance does not carry over. Your monthly allowance has no cash value, cannot be transferred and is separate from credits. Credits you buy as a pack, including a subscriber pack, are not affected when your monthly allowance resets. We use your free starter credits first, then your monthly allowance, then your credits. Subscriber packs are offered only while your plan is active, at most twice in each month of your plan.

Plan billing, renewal and cancellation

A plan is paid in advance, monthly or yearly as you choose, at the price shown when you subscribe. It renews automatically at the end of each billing period, and you are charged again for the next period, until you cancel. You can cancel at any time in Manage billing in the dashboard. When you cancel, your plan stays active until the end of the period you paid for and then does not renew; your monthly allowance stays usable until the end of its month. On yearly billing, a new monthly allowance is still added each month until the paid year ends. Plan payments are handled by Stripe as the seller of record, as described in the section on credits and payment.

Plan changes and price changes

You can move from Basic to Pro at any time. You pay the difference for the rest of your current billing period straight away, and the extra monthly allowance for that time is added at once. A move from Pro to Basic takes effect at the end of your current billing period; until then you keep Pro. A change between monthly and yearly billing also takes effect at the end of the current billing period. We may change a plan's price for future billing periods only after notice by email at least 30 days before the renewal it applies to; you can cancel before then.

Plan refunds, failed payments and disputes

If you ask within 30 days of a plan payment, we refund the share of that payment that matches the monthly allowance from it that you have not used. For yearly billing, the months that have not started are refundable within 30 days of the payment. Each plan payment, including a payment for a move to Pro, counts on its own. After 30 days, cancelling stops the next renewal and is not refunded. A move from Pro to Basic is not refunded. To ask, email support@pilot.e3d.ai from your account email. If a plan payment fails, your current monthly allowance stays usable until the end of that month, and no new monthly allowance is added until the payment succeeds; if it does not succeed after Stripe's retries, the plan ends. If a plan payment is refunded, we remove the matching monthly allowance. If a plan payment is disputed with your card issuer, we put the plan on hold until the dispute is resolved: while it is on hold, no new monthly allowance is added and the plan cannot be changed, and the plan is set to end at the end of its current billing period. We may also remove the monthly allowance from the disputed payment.

Invite codes

An invite code can be used once. It cannot be transferred or shared, and it expires on the date we give you with it. A code that has been used or has expired no longer works. Asking for early access does not entitle you to an invite code; we decide who receives one.

Output

Model output can be wrong, incomplete or different from one model to the next, and web content a model reads can be misleading. We do not promise that any answer is correct or fit for a purpose. You are responsible for how you use output and for any decision you make with it.

Protecting your data

We take reasonable steps to protect your data, described on our Security page. No system is free of risk. To report a vulnerability, write to security@pilot.e3d.ai.

Our property

We own the Service, its software and its brand. These terms give you a limited, non-exclusive, non-transferable right to use the Service while you comply with them. If you send us feedback, we may use it without obligation to you.

Availability

The Service runs on one server and depends on third-party AI companies and other providers. It is provided as available, and we do not promise that it will be uninterrupted or error-free.

Disclaimer

To the extent the law allows, the Service is provided "as is" and "as available", and we disclaim all warranties, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose and non-infringement.

Limit of liability

To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, and our total liability for all claims relating to the Service is limited to the greater of the amount you paid us in the 12 months before the event that gave rise to the claim and $100. Nothing in these terms limits liability that the law does not allow to be limited, such as liability for fraud or willful misconduct.

Your responsibility for your use

If you are a business customer, you will defend and compensate us against third-party claims, and the resulting costs, that arise from your content or from your use of the Service in breach of these terms, to the extent the law allows.

Changes to these terms

We may update these terms. We will tell you by email or in the dashboard and ask you to accept the new version; until you do, your keys and connectors will not run debates. If you do not agree to a new version, you can close your account. The version you accepted, and when, is stored with your account.

Ending your account

You can close your account in the dashboard at any time. We may end your account for a breach of these terms or to prevent harm. When an account is closed, its keys and sessions stop working and its stored debates and saved decisions are deleted from our live systems; copies in our backups are removed as the backups are replaced, and the AI companies keep data under their own terms. We keep payment and usage records, under a pseudonymous account id rather than your email, for accounting and disputes. Sections that by their nature should continue to apply after closing, such as limits of liability and governing law, do.

Governing law and courts

California law governs these terms and any dispute about them or the Service, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Contra Costa County, California, and you and we consent to those courts.

Data processing agreement

If you are a business customer and need a data processing addendum, email support@pilot.e3d.ai and we will provide one. It applies only once both sides have agreed to it.

Contact and notices

Write to support@pilot.e3d.ai. Legal notices to us must also go to that address. We may give you notices by email to your account address or in the dashboard.

The rest

These terms, together with the Privacy policy, are the whole agreement between you and us about the Service. If a part is found unenforceable, the rest stays in effect. If we do not enforce a term right away, we have not given it up.
